{"id":1801,"date":"2022-01-26T11:33:58","date_gmt":"2022-01-26T10:33:58","guid":{"rendered":"https:\/\/www.ariasassessors.com\/claves-de-los-erte-tras-la-reforma-laboral-2022\/"},"modified":"2022-01-26T11:46:45","modified_gmt":"2022-01-26T10:46:45","slug":"claves-de-los-erte-tras-la-reforma-laboral-2022","status":"publish","type":"post","link":"https:\/\/www.ariasassessors.com\/ca\/claves-de-los-erte-tras-la-reforma-laboral-2022\/","title":{"rendered":"Claus dels ERTO despr\u00e9s de la reforma laboral 2022"},"content":{"rendered":"<p>Dins de les mesures per a la modernitzaci\u00f3 de les mesures de flexibilitat interna de les empresa desenvolupades per el\u00a0<a href=\"https:\/\/www.iberley.es\/legislacion\/rd-ley-32-2021-28-dic-medidas-urgentes-reforma-laboral-garantia-estabilidad-empleo-transformacion-mercado-trabajo-27018396\">Reial decret llei 32\/2021, de 28 de desembre<\/a>, de mesures urgents per a la reforma laboral, la garantia de l&#8217;estabilitat en l&#8217;ocupaci\u00f3 i la transformaci\u00f3 del mercat de treball, trobem\u00a0<strong>mesures per a facilitar l&#8217;\u00fas dels expedients temporals d&#8217;ocupaci\u00f3 (ERTO)<\/strong>, com a f\u00f3rmula alternativa i priorit\u00e0ria a les extincions (mitjan\u00e7ant la modificaci\u00f3 de l&#8217;art.\u00a0<a href=\"https:\/\/www.iberley.es\/legislacion\/real-decreto-legislativo-2-2015-23-octubre-aprueba-texto-refundido-ley-estatuto-trabajadores-23860101?ancla=9677904#ancla_9677904\">47<\/a>\u00a0de el<a href=\"https:\/\/www.iberley.es\/legislacion\/real-decreto-legislativo-2-2015-23-octubre-aprueba-texto-refundido-ley-estatuto-trabajadores-23860101\">\u00a0ET<\/a>), i un\u00a0<strong>nou mecanisme de flexibilitat i estabilitzaci\u00f3 de l&#8217;ocupaci\u00f3<\/strong>\u00a0(nou\u00a0art. 47 bis de el\u00a0ET)\u00a0per a atendre les necessitats excepcionals de naturalesa macroecon\u00f2mica o sectorial que justifiquin l&#8217;adopci\u00f3 de mesures d&#8217;ajust i protecci\u00f3 temporal, aix\u00ed com inversions de car\u00e0cter p\u00fablic, pr\u00e8via declaraci\u00f3 de tal circumst\u00e0ncia mitjan\u00e7ant acord del Consell de Ministres, denominat \u00abMecanisme XARXA de Flexibilitat i Estabilitzaci\u00f3 de l&#8217;Ocupaci\u00f3\u00bb.<\/p>\n<p><strong>1.- ERTO ETOP<\/strong><\/p>\n<p><strong>Entrada en vigor de les modificacions:<\/strong>\u00a031\/12\/2021.<\/p>\n<p><strong>NOVETATS<\/strong><\/p>\n<p>&#8211; El\u00a0per\u00edode de consultes tindr\u00e0 una\u00a0durada no superior a quinze dies, no obstant aix\u00f2\u00a0\u00ab<em>en el sup\u00f2sit d&#8217;empreses de menys de 50 persones de plantilla, la durada del per\u00edode de consultes no ser\u00e0 superior a set dies\u00bb\u00a0(art.\u00a0<a href=\"https:\/\/www.iberley.es\/legislacion\/real-decreto-legislativo-2-2015-23-octubre-aprueba-texto-refundido-ley-estatuto-trabajadores-23860101?ancla=9677904#ancla_9677904\">47.3<\/a> de l&#8217;<a href=\"https:\/\/www.iberley.es\/legislacion\/real-decreto-legislativo-2-2015-23-octubre-aprueba-texto-refundido-ley-estatuto-trabajadores-23860101\">ET<\/a>).<\/em><\/p>\n<p>&#8211; L&#8217;empresa podr\u00e0 proposar una pr\u00f2rroga de l&#8217;ERTO\u00a0ETOP.<\/p>\n<p>&#8211; Es fixen una s\u00e8rie de normes comunes aplicables als expedients de regulaci\u00f3 temporal d&#8217;ocupaci\u00f3 per causes econ\u00f2miques, t\u00e8cniques, organitzatives i de producci\u00f3, i als quals estiguin basats en una causa de for\u00e7a major temporal: comunicaci\u00f3 de la mesura, possibilitat d&#8217;afectar o desafectar, prohibici\u00f3 de la realitzaci\u00f3 de\u00a0hores extraordin\u00e0ries,\u00a0externalitzacions d&#8217;activitat o noves contractacions laborals, salvaguarda d&#8217;ocupaci\u00f3 en cas de gaudi d&#8217;exoneracions en la cotitzaci\u00f3, etc.<\/p>\n<p>&#8211; Es regula la cotitzaci\u00f3 en els sup\u00f2sits de reducci\u00f3 de jornada o suspensi\u00f3 de contracte (art. <a href=\"https:\/\/www.iberley.es\/legislacion\/rdleg-8-2015-30-oct-tr-ley-general-seguridad-social-lgss-23990341?ancla=9677280#ancla_9677280\">153 bis<\/a>\u00a0de la\u00a0<a href=\"https:\/\/www.iberley.es\/legislacion\/rdleg-8-2015-30-oct-tr-ley-general-seguridad-social-lgss-23990341\">LGSS<\/a>).<\/p>\n<p>&#8211; S&#8217;estableixen exoneracions en la cotitzaci\u00f3 segons la mena d&#8217;ERTO subjectes als requisits regulats en la D.A. 39a de la <a href=\"https:\/\/www.iberley.es\/legislacion\/rdleg-8-2015-30-oct-tr-ley-general-seguridad-social-lgss-23990341\">LGSS<\/a>. Les exempcions en la cotitzaci\u00f3 estaran condicionades al manteniment en l&#8217;ocupaci\u00f3 de les persones treballadores afectades durant els sis mesos seg\u00fcents a la finalitzaci\u00f3 del per\u00edode de vig\u00e8ncia de l&#8217;expedient de regulaci\u00f3 temporal d&#8217;ocupaci\u00f3.<\/p>\n<p><strong>POSSIBILITATS<\/strong><\/p>\n<p>&#8211; Reduir temporalment la jornada de treball de les persones treballadores (entre un 10% i un 70%).<\/p>\n<p>&#8211; Suspendre temporalment els contractes de treball.<\/p>\n<p><strong>2.- ERTO for\u00e7a major<\/strong><\/p>\n<p><strong>Entrada en vigor de les modificacions:<\/strong>\u00a031\/12\/2021.<\/p>\n<p><strong>NOVETATS<\/strong><\/p>\n<p>&#8211; S&#8217;afegeix una regulaci\u00f3 permanent per als ERTO\u00a0per impediments o limitacions en l&#8217;activitat normalitzada de l&#8217;empresa que siguin conseq\u00fc\u00e8ncia de decisions adoptades per l&#8217;autoritat p\u00fablica competent, incloses aquelles orientades a la protecci\u00f3 de la salut p\u00fablica.<\/p>\n<p>&#8211; Es fixen una s\u00e8rie de normes comunes aplicables als expedients de regulaci\u00f3 temporal d&#8217;ocupaci\u00f3 per causes econ\u00f2miques, t\u00e8cniques, organitzatives i de producci\u00f3, i als quals estiguin basats en una causa de for\u00e7a major temporal: comunicaci\u00f3 de la mesura, possibilitat d&#8217;afectar o desafectar, prohibici\u00f3 de la realitzaci\u00f3 de\u00a0hores extraordin\u00e0ries, externalitzacions d&#8217;activitat o noves contractacions laborals, salvaguarda d&#8217;ocupaci\u00f3 en cas de gaudi d&#8217;exoneracions en la cotitzaci\u00f3, etc.<\/p>\n<p>&#8211; Es regula la cotitzaci\u00f3 en els sup\u00f2sits de reducci\u00f3 de jornada o suspensi\u00f3 de contracte (art. <a href=\"https:\/\/www.iberley.es\/legislacion\/rdleg-8-2015-30-oct-tr-ley-general-seguridad-social-lgss-23990341?ancla=9677280#ancla_9677280\">153 bis<\/a>\u00a0de la\u00a0<a href=\"https:\/\/www.iberley.es\/legislacion\/rdleg-8-2015-30-oct-tr-ley-general-seguridad-social-lgss-23990341\">LGSS<\/a>).<\/p>\n<p>-S&#8217;estableixen exoneracions en la cotitzaci\u00f3 segons la mena d&#8217;ERTO subjectes als requisits regulats en la D.A. 39a de la <a href=\"https:\/\/www.iberley.es\/legislacion\/rdleg-8-2015-30-oct-tr-ley-general-seguridad-social-lgss-23990341\">LGSS<\/a>. Les exempcions en la cotitzaci\u00f3 estaran condicionades al manteniment en l&#8217;ocupaci\u00f3 de les persones treballadores afectades durant els sis mesos seg\u00fcents a la finalitzaci\u00f3 del per\u00edode de vig\u00e8ncia de l&#8217;expedient de regulaci\u00f3 temporal d&#8217;ocupaci\u00f3.<\/p>\n<p><strong>POSSIBILITATS<\/strong><\/p>\n<p>&#8211; Reduir temporalment la jornada de treball de les persones treballadores\u00a0(entre un 10% i un 70%).<\/p>\n<p>&#8211; Suspendre temporalment els contractes de treball.<\/p>\n<ol start=\"3\">\n<li><strong>Normes comunes als ERTO\u00a0ETOP\u00a0i els ERTO for\u00e7a major<\/strong><\/li>\n<\/ol>\n<p>Des del 31\/12\/2021, la nova redacci\u00f3 de l&#8217;art. <a href=\"https:\/\/www.iberley.es\/legislacion\/real-decreto-legislativo-2-2015-23-octubre-aprueba-texto-refundido-ley-estatuto-trabajadores-23860101?ancla=9677904#ancla_9677904\">47.7<\/a> de l&#8217;<a href=\"https:\/\/www.iberley.es\/legislacion\/real-decreto-legislativo-2-2015-23-octubre-aprueba-texto-refundido-ley-estatuto-trabajadores-23860101\">ET<\/a> fixa una s\u00e8rie de\u00a0normes comunes aplicables als ERTO per causes econ\u00f2miques, t\u00e8cniques, organitzatives i de producci\u00f3, i als quals estiguin basats en una causa de for\u00e7a major temporal.<\/p>\n<ol start=\"4\">\n<li><strong>Mecanisme XARXA de Flexibilitat i Estabilitzaci\u00f3 de l&#8217;Ocupaci\u00f3<\/strong><\/li>\n<\/ol>\n<p><strong>Entrada en vigor de les modificacions:<\/strong>\u00a031\/12\/2021.<\/p>\n<p><strong>NOVETATS<\/strong><\/p>\n<p>&#8211; Es creen una s\u00e8rie de mesures, similars als ERTO ordinaris, que permetr\u00e0 a les empreses reduir la jornada o suspendre els contractes dels seus treballadors amb beneficis en les cotitzacions i prestacions sempre que es donin determinades circumst\u00e0ncies. El nou art. <a href=\"https:\/\/www.iberley.es\/legislacion\/real-decreto-legislativo-2-2015-23-octubre-aprueba-texto-refundido-ley-estatuto-trabajadores-23860101?ancla=9677904#ancla_9677904\">47 bis<\/a> de l&#8217;<a href=\"https:\/\/www.iberley.es\/legislacion\/real-decreto-legislativo-2-2015-23-octubre-aprueba-texto-refundido-ley-estatuto-trabajadores-23860101\">ET<\/a> els defineix com:\u00a0<em>\u00abEl Mecanisme XARXA de Flexibilitat i Estabilitzaci\u00f3 de l&#8217;Ocupaci\u00f3 \u00e9s un instrument de flexibilitat i estabilitzaci\u00f3 de l&#8217;ocupaci\u00f3 que, una vegada activat pel Consell de Ministres, permetr\u00e0 a les empreses la sol\u00b7licitud de mesures de reducci\u00f3 de jornada i suspensi\u00f3 de contractes de treball\u00bb.<\/em><\/p>\n<p>&#8211; La gesti\u00f3 del Fons XARXA correspondr\u00e0 al\u00a0SEPE\u00a0i es nodrir\u00e0 del super\u00e0vit d&#8217;ingressos per cotitzacions socials per desocupaci\u00f3, de les aportacions programes en els Pressupostos Generals de l&#8217;Estat, i de recursos procedents d&#8217;instruments de finan\u00e7ament de la Uni\u00f3 Europea.<\/p>\n<p>&#8211; S&#8217;estableixen exoneracions en la cotitzaci\u00f3 segons la mena d&#8217;ERTO subjectes als requisits regulats en la D.A. 39a de la\u00a0LGSS.\u00a0Les exempcions en la cotitzaci\u00f3 estaran condicionades al manteniment en l&#8217;ocupaci\u00f3 de les persones treballadores afectades durant els sis mesos seg\u00fcents a la finalitzaci\u00f3 del per\u00edode de vig\u00e8ncia de l&#8217;expedient de regulaci\u00f3 temporal d&#8217;ocupaci\u00f3.<\/p>\n<p><strong>ACTIVACI\u00d3 I SOL\u00b7LICITUD POR LES EMPRESES<\/strong><\/p>\n<p>L&#8217;activaci\u00f3 del Mecanisme es realitzar\u00e0 a proposta conjunta de les persones titulars dels Ministeris de Treball i Economia Social, d&#8217;Assumptes Econ\u00f2mics i Transformaci\u00f3 Digital, i d&#8217;Inclusi\u00f3, Seguretat Social i Migracions, previ informe de la Comissi\u00f3 Delegada del Govern per a Assumptes Econ\u00f2mics.<\/p>\n<p>Una vegada activat el Mecanisme, les empreses podran sol\u00b7licitar volunt\u00e0riament a l&#8217;autoritat laboral la reducci\u00f3 de la jornada o la suspensi\u00f3 dels contractes de treball, mentre estigui activat el Mecanisme, en qualsevol dels seus centres de treball i en els termes previstos.<\/p>\n<p><strong>POSSIBILITATS<\/strong><\/p>\n<p>&#8211; Reduir temporalment la jornada de treball de les persones treballadores (entre un 10% i un 70%).<\/p>\n<p>&#8211; Suspendre
