{"id":1903,"date":"2022-04-08T10:29:19","date_gmt":"2022-04-08T08:29:19","guid":{"rendered":"https:\/\/www.ariasassessors.com\/limite-subidas-de-los-alquileres\/"},"modified":"2022-04-08T10:39:05","modified_gmt":"2022-04-08T08:39:05","slug":"limite-subidas-de-los-alquileres","status":"publish","type":"post","link":"https:\/\/www.ariasassessors.com\/ca\/limite-subidas-de-los-alquileres\/","title":{"rendered":"L\u00edmit extraordinari a les pujades dels lloguers"},"content":{"rendered":"<p>El Govern ha aprovat una s\u00e8rie de mesures amb l&#8217;objectiu declarat de pal\u00b7liar parcialment la situaci\u00f3 actual de descontrol de preus que afecta el gas, al petroli, l&#8217;energia, els combustibles, gran part dels aliments i nombrosos materials. Una situaci\u00f3 que venia produint-se des de mitjan 2021 i que s&#8217;ha accentuat amb els efectes de la guerra d&#8217;Ucra\u00efna.<\/p>\n<p>El Reial decret llei 6\/2022 de 29 de mar\u00e7 s&#8217;ha publicat en el BOE el 30 de mar\u00e7 de 2022, amb entrada en vigor el 31 de mar\u00e7, i cont\u00e9 mesures molt diverses. Pel que concerneix els lloguers d&#8217;habitatge, s&#8217;ha aprovat una limitaci\u00f3 extraordin\u00e0ria a l&#8217;actualitzaci\u00f3 anual de la renda.<\/p>\n<p>La dada de l&#8217;IPC avan\u00e7at del mes de mar\u00e7 de 2022 \u00e9s del 9,8%, despr\u00e9s del 7,6% de febrer. I \u00e9s previsible que la inflaci\u00f3 es mantingui en nivells molt elevats durant els pr\u00f2xims mesos.<\/p>\n<p><a href=\"https:\/\/www.ocu.org\/fincas-y-casas\/compraventa\/panorama-inmobilario\/analisis-gratis\/2022\/03\/impacto-guerra-ucrania-en-vivienda\">L&#8217;impacte de la guerra d&#8217;Ucra\u00efna en l&#8217;habitatge.<\/a><\/p>\n<p>L&#8217;IPC \u00e9s el topall m\u00e0xim legal per a l&#8217;actualitzaci\u00f3 anual de la renda en els contractes de lloguer d&#8217;habitatge, segons la vigent Llei d&#8217;Arrendaments Urbans. Amb l&#8217;IPC de mar\u00e7, una renda mensual de 1.000 euros que hagu\u00e9s d&#8217;actualitzar-se passaria a ser de 1.098 euros mensuals.<\/p>\n<p>Fins al 30 de juny de 2022 (termini provisional) l&#8217;actualitzaci\u00f3 de la renda no podr\u00e0 superar el marcat per l&#8217;\u00cdndex de Garantia de la Competitivitat. L&#8217;\u00faltim\u00a0IGC\u00a0publicat per l&#8217;INE \u00e9s de gener de 2022 i estava en el 2,02%. Per\u00f2 la normativa d&#8217;aquest \u00edndex estableix uns l\u00edmits per dalt i per sota, de manera que l&#8217;\u00edndex mai pot ser inferior al 0% ni superior al 2%. \u00c9s a dir, quan el\u00a0IGC\u00a0superi el 2%, es pren com a valor de refer\u00e8ncia el 2%.<\/p>\n<p>De manera que als contractes que els toqui fer l&#8217;actualitzaci\u00f3 de rendes en els mesos d&#8217;abril, maig i juny de 2022 utilitzaran com a valor de refer\u00e8ncia la variaci\u00f3 del\u00a0IGC\u00a0que correspongui a l&#8217;\u00faltim \u00edndex que estigu\u00e9s publicat en la data d&#8217;actualitzaci\u00f3 del contracte.\u00a0En la pr\u00e0ctica, nom\u00e9s se&#8217;ls podr\u00e0 aplicar <strong>una\u00a0pujada m\u00e0xima del 2%.<\/strong><\/p>\n<p>Diem pujada m\u00e0xima perqu\u00e8, com \u00e9s sabut, les actualitzacions de renda no s\u00f3n obligat\u00f2ries si una de les parts no ho demana expressament.<\/p>\n<p><a href=\"https:\/\/www.ocu.org\/fincas-y-casas\/gestion\/alquiler\/analisis\/2021\/09\/actualizar-rentas-alquiler-con-ipc\">Com actualitzar la renda dels lloguers.<\/a><\/p>\n<h2>El l\u00edmit tamb\u00e9 afecta als petits arrendadors<\/h2>\n<p>La norma fa una lleu distinci\u00f3 entre els arrendadors que siguin grans tenidors i els que no ho siguin. A aquest efecte es considera gran tenidor a les persona f\u00edsica o jur\u00eddica que sigui titular de m\u00e9s de deu immobles urbans d&#8217;\u00fas residencial o una superf\u00edcie constru\u00efda de m\u00e9s de 1.500 m\u00b2 d&#8217;\u00fas residencial, excloent en tot cas garatges i trasters. Per a grans tenidors, l&#8217;actualitzaci\u00f3 de la renda que pactin les parts no podr\u00e0 excedir la variaci\u00f3 del IGC. Mancant pacte regeix igualment el l\u00edmit del IGC.<\/p>\n<p>Per a\u00a0petits\u00a0arrendadors preval el pacte que puguin aconseguir les parts sobre l&#8217;actualitzaci\u00f3, per\u00f2 sabent que si no hi ha pacte, s&#8217;imposa el l\u00edmit de la variaci\u00f3 del\u00a0IGC. No \u00e9s previsible que els inquilins arribin a acords temporals de pujada de rendes que superin la variaci\u00f3 del\u00a0IGC. Pel que s&#8217;espera que la pujada m\u00e0xima per a tots els afectats estigui subjecta a aquest l\u00edmit del 2%.<\/p>\n<p>Ara b\u00e9, si un arrendador (que no sigui gran tenidor) i un inquil\u00ed pacten una cosa diferent, prima el pacte.
