class=\"ez-toc-section-end\"><\/span><\/h2>\n<p class=\"\" data-start=\"833\" data-end=\"1203\">El conegut <em data-start=\"844\" data-end=\"861\">plus de festius<\/em> \u00e9s un complement salarial que s\u2019abona als treballadors que presten servei en dies no laborables, com diumenges o festius. Aquest concepte, que durant anys ha generat dubtes i aplicacions diverses segons el sector i el conveni, ha tornat al primer pla arran d\u2019una sent\u00e8ncia que redefineix els drets laborals&#8230; i les obligacions empresarials.<\/p>\n<p class=\"\" data-start=\"1205\" data-end=\"1508\">Fins ara, moltes empreses entenien que, si una persona era contractada exclusivament per treballar caps de setmana o festius, aquests dies ja formaven part de la seva jornada ordin\u00e0ria. Per tant, no era necessari cap pagament addicional. Per\u00f2 el <strong data-start=\"1451\" data-end=\"1507\"><a href=\"https:\/\/www.poderjudicial.es\/cgpj\/es\/Poder-Judicial\/Tribunal-Supremo\/\">Tribunal Suprem<\/a> ha trencat amb aquesta interpretaci\u00f3<\/strong>.<\/p>\n<p class=\"\" data-start=\"1510\" data-end=\"1808\">A <a href=\"https:\/\/www.ariasassessors.com\/\"><strong data-start=\"1512\" data-end=\"1531\">Arias Assessors<\/strong><\/a>, fa anys que assessorem negocis d\u2019hostaleria, comer\u00e7 i serveis que depenen de personal eventual durant els caps de setmana. Una de les preguntes m\u00e9s habituals era: <em data-start=\"1696\" data-end=\"1754\">he de pagar un extra si ja treballen sempre en diumenge?<\/em> Ara ja tenim una resposta jur\u00eddica clara i vinculant.<\/p>\n<h2 class=\"\" data-start=\"1810\" data-end=\"1864\"><span class=\"ez-toc-section\" id=\"La_nova_sentencia_del_Suprem_un_abans_i_un_despres\"><\/span>La nova sent\u00e8ncia del Suprem: un abans i un despr\u00e9s<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p class=\"\" data-start=\"1866\" data-end=\"2147\">La Sent\u00e8ncia 165\/2025, dictada el 4 de mar\u00e7 per la Sala Social del Tribunal Suprem, estableix que <strong data-start=\"1964\" data-end=\"2088\">tots els treballadors contractats per treballar exclusivament en caps de setmana o festius tenen dret al plus de festius<\/strong>, sempre que aquest estigui recollit al conveni col\u00b7lectiu.<\/p>\n<p class=\"\" data-start=\"2149\" data-end=\"2489\">La resoluci\u00f3 anul\u00b7la decisions anteriors que denegaven aquest dret, al\u00b7legant que no es tractava d\u2019un horari especial. El Suprem considera que aix\u00f2 suposa <strong data-start=\"2304\" data-end=\"2325\">una discriminaci\u00f3<\/strong>, sobretot si la retribuci\u00f3 d\u2019aquests empleats \u00e9s la mateixa que la dels treballadors de jornada ordin\u00e0ria que s\u00ed cobren el plus per treballar algun festiu puntual.<\/p>\n<p class=\"\" data-start=\"2491\" data-end=\"2735\">Des de la nostra assessoria, considerem que aquest canvi <strong data-start=\"2548\" data-end=\"2586\">canvia totalment les regles de joc<\/strong> per a aut\u00f2noms, petits negocis i empreses amb refor\u00e7 de plantilla en festius o caps de setmana. Ja no es tracta d\u2019un detall: \u00e9s una obligaci\u00f3 legal.<\/p>\n<h2 class=\"\" data-start=\"2737\" data-end=\"2787\"><span class=\"ez-toc-section\" id=\"A_qui_afecta_realment_aquesta_decisio_judicial\"><\/span>A qui afecta realment aquesta decisi\u00f3 judicial?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p class=\"\" data-start=\"2789\" data-end=\"2955\">Encara que s\u2019ha presentat com una mesura dirigida als aut\u00f2noms, la veritat \u00e9s que <strong data-start=\"2871\" data-end=\"2901\">afecta qualsevol empresari<\/strong> que utilitzi contractes parcials o de cap de setmana.<\/p>\n<p class=\"\" data-start=\"2957\" data-end=\"2984\">Els perfils m\u00e9s comuns s\u00f3n:<\/p>\n<ul data-start=\"2986\" data-end=\"3204\">\n<li class=\"\" data-start=\"2986\" data-end=\"3038\">\n<p class=\"\" data-start=\"2988\" data-end=\"3038\">Cambrers o personal d\u2019hostaleria de cap de setmana<\/p>\n<\/li>\n<li class=\"\" data-start=\"3039\" data-end=\"3084\">\n<p class=\"\" data-start=\"3041\" data-end=\"3084\">Dependents o personal de refor\u00e7 en comer\u00e7os<\/p>\n<\/li>\n<li class=\"\" data-start=\"3085\" data-end=\"3134\">\n<p class=\"\" data-start=\"3087\" data-end=\"3134\">Estudiants contractats per treballar en festius<\/p>\n<\/li>\n<li class=\"\" data-start=\"3135\" data-end=\"3204\">\n<p class=\"\" data-start=\"3137\" data-end=\"3204\">Treballadors amb jornada parcial repartida nom\u00e9s en caps de setmana<\/p>\n<\/li>\n<\/ul>\n<p class=\"\" data-start=\"3206\" data-end=\"3344\">Tots ells, si el conveni aplicable estableix un <em data-start=\"3254\" data-end=\"3271\">plus de festius<\/em>, <strong data-start=\"3273\" data-end=\"3343\">tenen dret a cobrar-lo encara que treballin sempre en aquests dies<\/strong>.<\/p>\n<p class=\"\" data-start=\"3346\" data-end=\"3558\">A Arias Assessors hem revisat desenes de convenis sectorials i, en la gran majoria, hi figura aquest complement, sigui com a plus de festius, complement per jornades especials o retribuci\u00f3 per dies no laborables.<\/p>\n<h2 class=\"\" data-start=\"3560\" data-end=\"3636\"><span class=\"ez-toc-section\" id=\"Autonoms_que_contracten_nomes_caps_de_setmana_que_han_de_tenir_en_compte\"><\/span>Aut\u00f2noms que contracten nom\u00e9s caps de setmana: qu\u00e8 han de tenir en compte<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p class=\"\" data-start=\"3638\" data-end=\"3878\">Molts dels nostres clients s\u00f3n aut\u00f2noms que gestionen un restaurant, un bar, una botiga o un centre de serveis. Contracten refor\u00e7 nom\u00e9s durant el cap de setmana o en ponts. Amb la nova doctrina, <strong data-start=\"3833\" data-end=\"3877\">ja no poden ignorar el pagament del plus<\/strong>.<\/p>\n<p class=\"\" data-start=\"3880\" data-end=\"4064\">\u00c9s essencial revisar els contractes i les n\u00f2mines. El plus est\u00e0 reflectit de manera clara? S\u2019especifica a la n\u00f2mina com un concepte a part? Es contempla expl\u00edcitament en la retribuci\u00f3?<\/p>\n<p class=\"\" data-start=\"4066\" data-end=\"4265\">La nostra recomanaci\u00f3 \u00e9s <strong data-start=\"4091\" data-end=\"4112\">actuar de seguida<\/strong>, per evitar reclamacions i sancions. Si el conveni col\u00b7lectiu <strong data-start=\"4395\" data-end=\"4454\">no contempla un plus espec\u00edfic per treballar en festius<\/strong>, l\u2019obligaci\u00f3 de pagament <strong data-start=\"4480\" data-end=\"4495\">no existeix<\/strong>.<\/p>\n<p class=\"\" data-start=\"4498\" data-end=\"4714\">Tanmateix, el Tribunal ha indicat que <strong data-start=\"4536\" data-end=\"4614\">no es pot pagar el mateix salari que a un treballador que no fa cap festiu<\/strong>, sense cap tipus de compensaci\u00f3. Aix\u00f2 podria considerar-se una situaci\u00f3 de desigualtat retributiva.<\/p>\n<p class=\"\" data-start=\"4716\" data-end=\"4938\">Per aix\u00f2, \u00e9s essencial revisar a fons els convenis aplicables. Alguns el recullen de manera indirecta o amb altres noms. En alguns, \u00e9s un <strong data-start=\"5049\" data-end=\"5080\">percentatge del salari base<\/strong>, en altres una <strong data-start=\"5096\" data-end=\"5144\">quantitat fixa per cada dia festiu treballat<\/strong>. Tamb\u00e9 pot haver-hi compensaci\u00f3 amb dies de descans addicionals.<\/p>\n<p class=\"\" data-start=\"5211\" data-end=\"5258\">A la pr\u00e0ctica, ens hem trobat casos com aquest:<\/p>\n<blockquote data-start=\"5260\" data-end=\"5406\">\n<p class=\"\" data-start=\"5262\" data-end=\"5406\">Un treballador que fa 8 diumenges al mes, amb un plus fixat en 15\u20ac per dia, hauria de percebre <strong data-start=\"5357\" data-end=\"5380\">120\u20ac extra cada mes<\/strong>, a part del seu sou base.<\/p>\n<\/blockquote>\n<p class=\"\" data-start=\"5408\" data-end=\"5535\">Aquest import <strong data-start=\"5422\" data-end=\"5453\">ha de figurar expl\u00edcitament<\/strong> en la n\u00f2mina. Si no es detalla, es considera que <strong data-start=\"5503\" data-end=\"5534\">no s\u2019ha abonat correctament<\/strong>.<\/p>\n<h2 class=\"\" data-start=\"5537\" data-end=\"5592\"><span class=\"ez-toc-section\" id=\"Errors_habituals_que_hem_detectat_i_com_evitar-los\"><\/span>Errors habituals que hem detectat (i com evitar-los)<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<ol data-start=\"5594\" data-end=\"5825\">\n<li class=\"\" data-start=\"5594\" data-end=\"5641\">\n<p class=\"\" data-start=\"5597\" data-end=\"5641\"><strong data-start=\"5597\" data-end=\"5641\">No especificar els complements salarials<\/strong><\/p>\n<\/li>\n<li class=\"\" data-start=\"5642\" data-end=\"5710\">\n<p class=\"\" data-start=\"5645\" data-end=\"5710\"><strong data-start=\"5645\" data-end=\"5710\">Assumir que la jornada en cap de setmana no implica cap extra<\/strong><\/p>\n<\/li>\n<li class=\"\" data-start=\"5711\" data-end=\"5782\">\n<p class=\"\" data-start=\"5714\" data-end=\"5782\"><strong data-start=\"5714\" data-end=\"5782\">Utilitzar contractes gen\u00e8rics sense aplicar el conveni sectorial<\/strong><\/p>\n<\/li>\n<li class=\"\" data-start=\"5783\" data-end=\"5825\">\n<p class=\"\" data-start=\"5786\" data-end=\"5825\"><strong data-start=\"5786\" data-end=\"5825\">No actualitzar els models de n\u00f2mina<\/strong><\/p>\n<\/li>\n<\/ol>\n<p class=\"\" data-start=\"5827\" data-end=\"5960\">Evitar aquests errors \u00e9s fonamental.
