l\u2019\u00e0mbit laboral entre situacions de persones treballadores i empreses davant <strong>coronavirus<\/strong>.<\/p>\n<p><!--more--><\/p>\n<p><strong>Front laboral normal al Coronavirus<\/strong><\/p>\n<p>Tal i com senyala el <a href=\"https:\/\/www.mscbs.gob.es\/ca\/\">Ministeri de Sanitat<\/a> en relaci\u00f3 amb la protecci\u00f3 de les persones treballadores amb risc d\u2019exposici\u00f3 al nou coronavirus, que es pot partir d\u2019una s\u00e8rie de premisses:<\/p>\n<p>a) El coronavirus \u00e9s un virus desconegut anteriorment en la patologia humana.<br \/>\nb) Les mesures d&#8217;a\u00efllament, en els casos investigats, constitueixen la primera barrera de protecci\u00f3 tant de la persona treballadora afectada com dels restants susceptibles de contacte amb el pacient.<\/p>\n<p><strong>Situacions a les que es poden trobar empreses i treballadors<\/strong><\/p>\n<ol>\n<li>\n<div id=\"ez-toc-container\" class=\"ez-toc-v2_0_72 counter-hierarchy ez-toc-counter ez-toc-grey ez-toc-container-direction\">\n<div class=\"ez-toc-title-container\">\n<p class=\"ez-toc-title\" style=\"cursor:inherit\">\u00cdndice de Contenidos<\/p>\n<span id=\"Paralitzacio_de_lactivitat_per_decisio_de_lempresa\"><\/span><strong>Paralitzaci\u00f3 de l\u2019activitat per decisi\u00f3 de l\u2019empresa<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n<\/li>\n<\/ol>\n<p>Les empreses poden adoptar mesures organitzatives o preventives que, de manera temporal, eviten situacions de contacte social, sense necessitat de paral\u00b7lelitzar la seva activitat.<br \/>\nSense obstinaci\u00f3, i per a qu\u00e8 aix\u00f2 no sigui possible, es conformi amb el seu reconeixement en el mateix article 21 de la llei 31\/1995, de 8 de novembre, de Prevenci\u00f3 de Riscos Laborals (LPRL), i en el que s\u2019adapta al risc de contagi per coronavirus, quan les persones treballadores estiguin o puguin estar exposats a un greu risc i imminent amb alguna ocasi\u00f3 el seu treball, l\u2019empresa estar\u00e0 obligada a:<br \/>\n\u2022 informar abans que fos possible l\u2019exist\u00e8ncia de declaracions de risc,<br \/>\n\u2022 adoptar les mesures i les instruccions necess\u00e0ries per a fer, en cas de perill greu, imminent i inevitable, les persones treballadores puguin interrompre la seva activitat i, si fos necessari, abandonar immediatament el lloc de treball.<\/p>\n<ol start=\"2\">\n<li>\n<h4><span class=\"ez-toc-section\" id=\"Paralitzacio_de_lactivitat_per_decisio_de_les_persones_treballadores\"><\/span>Paralitzaci\u00f3 de l\u2019activitat per decisi\u00f3 de les persones treballadores<span class=\"ez-toc-section-end\"><\/span><\/h4>\n<\/li>\n<\/ol>\n<p>En cas que la prestaci\u00f3 de serveis al centre de treball comporti una gravetat de risc i imminent de contagi per coronavirus, i en l&#8217;aplicaci\u00f3 de la previsi\u00f3 al mencionat article 21 LPRL, al seu apartat 2, Les persones treballadores podrien interrompre la seva activitat i abandonar el centre de treball.<\/p>\n<p>Aix\u00ed mateix, per decisi\u00f3 majorit\u00e0ria, la representaci\u00f3 unit\u00e0ria o les delegades i delegats de prevenci\u00f3, podran acordar la paralitzaci\u00f3 de l&#8217;activitat de les persones treballadores afectades pel risc de contagi greu i imminent per coronavirus. Les persones treballadores i els seus representants no poden patir cap perjudici derivat de l&#8217;adopci\u00f3 de les mesures a qu\u00e8 es refereixen els apartats anteriors, llevat que haguessin obrat de mala fe o com\u00e8s neglig\u00e8ncia greu.<\/p>\n<p>En tot cas, les empreses han d&#8217;adoptar aquelles mesures preventives de car\u00e0cter col\u00b7lectiu o individual que siguin indicades, si escau, pel servei prevenci\u00f3 d&#8217;acord amb l&#8217;avaluaci\u00f3 de riscos per coronavirus, \u00e9s a dir, en funci\u00f3 de l&#8217;tipus d&#8217;activitat, distribuci\u00f3 i caracter\u00edstiques concretes de l&#8217;activitat que l&#8217;empresa realitzi. Entre les mesures que es poden adoptar d&#8217;acord amb les indicacions de l&#8217;servei de prevenci\u00f3 i sempre en atenci\u00f3 a les recomanacions establertes per les autoritats sanit\u00e0ries, hi ha les seg\u00fcents:<\/p>\n<p>a) Organitzar el treball de manera que es redueixi el nombre de persones treballadores exposades, establint regles per evitar i reduir la freq\u00fc\u00e8ncia i el tipus de contacte de persona a persona.<br \/>\nb) Adoptar, si \u00e9s el cas, mesures espec\u00edfiques per a les persones treballadores especialment. Proporcionar informaci\u00f3 sobre mesures higi\u00e8niques, com rentar-se les mans amb freq\u00fc\u00e8ncia, no compartir objectes, ventilaci\u00f3 de centre de treball, i la neteja de superf\u00edcies i objectes. En aquest sentit, les empreses han de posar a disposici\u00f3 de les persones treballadores el material higi\u00e8nic necessari, i adoptar els protocols de neteja que fossin precisos.<\/p>\n<ol>\n<li>\n<h4><span class=\"ez-toc-section\" id=\"El_Teletreball_com_a_mesura_organitzativa\"><\/span>El Teletreball com a mesura organitzativa<span class=\"ez-toc-section-end\"><\/span><\/h4>\n<\/li>\n<\/ol>\n<div class=\"tlid-input input\">\n<div class=\"source-wrap\">\n<div class=\"input-full-height-wrapper tlid-input-full-height-wrapper\">\n<div class=\"source-input\">\n<div class=\"source-footer-wrap source-or-target-footer\"><\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"tlid-results-container results-container\">\n<div class=\"tlid-result result-dict-wrapper\">\n<div class=\"result tlid-copy-target\">\n<div class=\"text-wrap tlid-copy-target\">\n<div class=\"result-shield-container tlid-copy-target\" tabindex=\"0\"><span class=\"tlid-translation translation\" lang=\"ca\"><span title=\"\">En aquells<\/span> <span title=\"\">sup\u00f2sits en qu\u00e8<\/span> <span title=\"\">no<\/span> <span title=\"\">es<\/span> <span title=\"\">prevegi<\/span> <span title=\"\">inicialment en el<\/span> <span title=\"\">contracte<\/span> <span title=\"\">de treball <\/span><span title=\"\">com una<\/span> <span title=\"\">mesura temporal<\/span> <span title=\"\">que impliqui la<\/span> <span title=\"\">prestaci\u00f3 de<\/span> <span title=\"\">serveis fora de<\/span> <span title=\"\">centre de <\/span><span title=\"\">treball habitual<\/span><span title=\"\">, el teletreball<\/span> <span title=\"\">podria adoptar<\/span> <span title=\"\">per acord<\/span> <span title=\"\">col\u00b7lectiu o<\/span> <span title=\"\">individual<\/span><span title=\"\">, amb un <\/span><span title=\"\">car\u00e0cter<\/span> <span title=\"\">excepcional<\/span><span title=\"\">, per al desenvolupament<\/span> <span title=\"\">de tasques<\/span> <span class=\"\" title=\"\">imprescindibles que<\/span> <span title=\"\">no puguin<\/span> <span title=\"\">desenvolupar-se <\/span><span title=\"\">al centre<\/span> <span class=\"\" title=\"\">f\u00edsic habitual<\/span><span title=\"\">,<\/span> <span title=\"\">un cop s&#8217;hagin<\/span> <span title=\"\">establert els<\/span> <span title=\"\">ajustos<\/span> <span title=\"\">o<\/span> <span title=\"\">precaucions <\/span><span title=\"\">necess\u00e0ries<\/span> <span title=\"\">de tipus<\/span> <span title=\"\">sanitari<\/span> <span title=\"\">i<\/span> <span class=\"\" title=\"\">preventiu,<\/span> <span title=\"\">i<\/span> <span title=\"\">d&#8217;acord amb els<\/span> <span title=\"\">procediments<\/span> <span title=\"\">regulats en el <\/span><span title=\"\">Estatut dels<\/span> <span title=\"\">Treballadors<\/span><span title=\"\">.<\/span><br \/>\n<span title=\"\">En aquest<\/span> <span title=\"\">article<\/span> <span title=\"\">d&#8217;Arias<\/span> <span class=\"\" title=\"\">Assessors,<\/span> <span title=\"\">expliquem<\/span> <span title=\"\">com <\/span><\/span><a href=\"https:\/\/www.ariasassessors.com\/ca\/com-implementar-el-teletreball-a-la-empresa\/\">com <span class=\"tlid-translation translation\" lang=\"ca\"><span title=\"\">implementar<\/span> <span title=\"\">el teletreball<\/span> <span title=\"\">a l&#8217;empresa.<\/span><\/span><\/a><\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<ol start=\"2\">\n<li>\n<h4><span class=\"ez-toc-section\" id=\"Suspensio_total_o_parcial_de_lactivitat_per_expedient_de_regulacio_docupacio\"><\/span><strong>Suspensi\u00f3 total o parcial de l&#8217;activitat per expedient de regulaci\u00f3 d&#8217;ocupaci\u00f3<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n<\/li>\n<\/ol>\n<p>Si l&#8217;empresa es vei\u00e9s en la necessitat de suspendre la seva activitat de manera total o parcial, ja sigui per decisi\u00f3 de les autoritats sanit\u00e0ries o b\u00e9 de manera indirecta pels efectes de l&#8217;coronavirus en l&#8217;\u00e0mbit laboral per acompliment normal la seva activitat, podr\u00e0 fer-ho d&#8217;acord amb els mecanismes que preveu la normativa laboral vigent i per les causes previstes en la mateixa -article 47 de l&#8217;Estatut dels Treballadors i Real Decret 1483\/2012, de 29 d&#8217;octubre, pel qual s&#8217;aprova el Reglament dels procediments d&#8217;acomiadament col\u00b7lectiu i de suspensi\u00f3 de contractes i reducci\u00f3 de jornada-<\/p>\n<ol start=\"3\">\n<li>\n<h4><span class=\"ez-toc-section\" id=\"Suspensio_total_o_parcial_de_lactivitat_sense_tramitacio_dun_expedient_de_regulacio_docupacio\"><\/span><strong>Suspensi\u00f3 total o parcial de l&#8217;activitat sense tramitaci\u00f3 d&#8217;un expedient de regulaci\u00f3 d&#8217;ocupaci\u00f3<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n<\/li>\n<\/ol>\n<p>En el cas que l&#8217;empresa afectada per alguna de les causes productives, organitzatives o t\u00e8cniques no proced\u00eds a la comunicaci\u00f3 d&#8217;un expedient de regulaci\u00f3 d&#8217;ocupaci\u00f3 per\u00f2 igualment paralitzar la seva activitat, resultaria aplicable el que preveu l&#8217;article 30 ET, de manera que la persona treballadora conservar\u00e0 el dret al seu salari.<\/p>\n<p>No obstant aix\u00f2 el contingut d&#8217;aquesta Guia, tot aix\u00f2 s&#8217;ha d&#8217;entendre sense perjudici del que preveu en la Llei 17\/2015, de 9 de juliol, de el Sistema Nacional de Protecci\u00f3 Civil. en el seu article 24.2.b), a prop\u00f2sit de la declaraci\u00f3 d&#8217;una zona afectada greument per una emerg\u00e8ncia de protecci\u00f3 civil:<br \/>\n&#8220;Les extincions o suspensions dels contractes de treball o les reduccions temporals de la jornada de treball que tinguin la seva causa directa en l&#8217;emerg\u00e8ncia, aix\u00ed com en les p\u00e8rdues d&#8217;activitat directament derivades de la mateixa que quedin degudament acreditades, tindran la consideraci\u00f3 de provinents d&#8217;una situaci\u00f3 de for\u00e7a major, amb les conseq\u00fc\u00e8ncies que es deriven dels articles 47 i 51 de el text ref\u00f3s de la Llei de l&#8217;Estatut dels Treballadors, aprovat pel Reial Decret Legislatiu 1\/1995, de 24 de mar\u00e7. En el primer sup\u00f2sit, la Tresoreria General de la Seguretat Social podr\u00e0 exonerar l&#8217;empresari de l&#8217;abonament de les quotes de la Seguretat Social i per conceptes de recaptaci\u00f3 conjunta mentre duri el per\u00edode de suspensi\u00f3, mantenint-se la condici\u00f3 d&#8217;aquest per\u00edode com a efectivament cotitzat pel treballador. En els casos en que es produeixi extinci\u00f3 de el contracte, les indemnitzacions dels treballadors van a c\u00e0rrec de el Fons de Garantia Salarial, amb els l\u00edmits legalment establerts.
